1. Preamble and acceptance
By registering, accessing or using the Platform, the User fully accepts these Terms, the Privacy Policy, the Cookie Policy and the Community Guidelines. If they do not accept, the User must refrain from using the Platform. Outzone may amend the Terms with at least 15 days' notice.
2. Definitions
For the purposes of these Terms the following definitions apply:
- Platform: the Outzone mobile app and website and related services.
- User: the natural person registered on or using the services.
- Organizer: who publishes events and manages ticket sales.
- Event / Ticket: the published activity and the related digital access title.
- Privacy Levels: the visibility settings Public, Friends, Private.
3. Nature of the service
Outzone is a technology platform acting as a digital intermediary between Users and Organizers, combining event discovery, ticketing and social features. In particular:
- Outzone is NOT the organizer of the Events and is not liable for their conduct, quality, safety or cancellation: liability lies with the Organizer.
- Outzone is NOT a Payment Service Provider and does not hold funds: transactions are handled via Stripe Connect Express.
4. Registration and Account
Registration is free and reserved to natural persons who are at least 16 years old; for minors aged 16-18 the consent of a parent or guardian is required. The User is responsible for the truthfulness of their data and the safekeeping of their credentials, and must report any unauthorized use. In summary:
- Requirements: minimum age 16; automatic restrictions for Events reserved to adults.
- Truthfulness: false data or impersonation may lead to suspension or closure of the Account.
- Security: strong credentials and, where available, two-factor authentication.
5. Platform features
The Platform offers, indicatively:
- Event discovery and interactive map to explore Events in your area.
- Ticket purchase, governed by the Ticket Sale Terms & Refund Policy accepted at checkout.
- Profile and social identity, with visibility governed by the Privacy Levels.
- Two-way friendship system and chat (event group and direct messages between friends).
- Geolocation subject to explicit consent, following the three-tier model described in the Privacy Policy.
6. Privacy controls
The User can configure three Privacy Levels (Public, Friends, Private) that govern their visibility on profile, events, participant list and chat. In line with Privacy by Default, new adult Users start at the Friends level and minors at the Private level; background geolocation and marketing notifications are off by default. Regardless of the level chosen, the Organizer of the Event for which the User purchased a Ticket receives the data strictly necessary for management (name, email, Ticket code).
7. Ticket purchase and Event Terms
Ticket purchases are governed by the Ticket Sale Terms & Refund Policy, accepted at checkout, which regulate among other things the User's rights in case of venue change, postponement or bringing forward of the date, headliner change and cancellation. Outzone does not hold funds: transactions and refunds are processed via Stripe Connect Express from the Organizer's account.
8. User conduct
The User undertakes to use the Platform in compliance with the law, these Terms, the Community Guidelines and respect for others. The following are in particular prohibited:
- Posting unlawful, offensive, discriminatory, violent, defamatory content or content infringing third-party rights.
- Sending unsolicited communications, harassment or threats to other Users.
- Circumventing others' Privacy Levels or re-identifying Users via proximity data.
- Using the Platform for spam, phishing, fraud or other unlawful activities, including unauthorized ticket resale.
- Using bots, scrapers or automated tools without written consent, or compromising the Platform's security.
9. User-uploaded content
The User retains ownership of the Content they upload and grants Outzone a non-exclusive, royalty-free, worldwide license for purposes connected with the operation, promotion and improvement of the Platform, within the limits of the Privacy Levels set. The license ends upon removal of the Content or closure of the Account, save for backup, security or legal obligations. In particular:
- The User warrants that they hold all rights necessary in the uploaded Content.
- The User indemnifies Outzone against third-party claims relating to the Content.
10. Reports and moderation
The Platform provides a reporting system for content, messages, profiles or events that breach the Terms or the Community Guidelines. Outzone reviews reports as promptly as possible (normally within 24-72 business hours) and takes appropriate action, up to removal of content or closure of the Account. Bad-faith reports may have consequences for the reporter.
11. Account suspension and closure
Outzone applies a system of progressive sanctions in case of breach:
- Warning: formal notice with an invitation to correct the conduct.
- Temporary suspension (7 days) for repeated or medium-severity breaches.
- Extended suspension (30 days) for further or serious breaches.
- Permanent ban in case of very serious breaches, fraud or protection of minors and vulnerable persons.
12. Intellectual property
All intellectual property rights relating to the Platform — trademarks, logos, software, design, texts, graphics, code and databases — are the exclusive property of Outzone Sagl or its licensors. The "outzone" trademark, the logo and the outzone.app domain are protected: any unauthorized use is prohibited.
13. Limitation of liability
Outzone provides the Platform "as is", without warranties of uninterrupted operation or absence of errors. To the extent permitted by law, Outzone is not liable for:
- Quality, conduct, safety, cancellation or modification of the Events.
- Unlawful or harmful conduct of other Users or Organizers.
- Technical malfunctions, interruptions or unauthorized access due to external factors or User negligence.
- Damage arising from third-party services (e.g. Stripe, hosting, maps).
14. Personal data processing
Data processing is carried out in compliance with the FADP and, where applicable, the GDPR. For details — geolocation, Privacy Levels, message retention, profiling, transfers to Stripe and other providers, and User rights — please refer to the Privacy Policy.
15. Miscellaneous
The following provisions also apply:
- Force majeure: Outzone is not liable for non-performance due to causes beyond its reasonable control.
- Assignment: the User may not assign their rights without written consent; Outzone may assign the contract in the context of reorganizations, giving notice.
- Partial invalidity: the invalidity of one clause does not affect the remaining ones.
- Communications: to Outzone via info@outzone.app; to the User via the Platform, the registered email or notifications.
16. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding conflict-of-law rules and the Vienna Convention on the international sale of goods (CISG). For any dispute the courts of Lugano have exclusive jurisdiction, save for mandatory consumer-protection provisions. Where required, Outzone adheres to the applicable mediation system and the competent Ombudsman.
