These Terms of Use (the "Terms") govern access to and use of the Outzone platform — mobile app and website — operated by Outzone Sagl ("Outzone", "we", "us"), a platform for event discovery, ticketing and light social features. These Terms also constitute the end-user licence agreement (EULA) for the application between you and Outzone.
Please read these Terms carefully. By registering, accessing or using the Platform you accept these Terms in full. If you do not accept them, do not use the Platform.
If there is any divergence between the Italian and English versions of these Terms, the Italian version prevails.
1. Who we are (controller and identification details)
The Platform is operated by:

2. Definitions
- "Platform": the Outzone mobile app and website, together with all accessible services, content and features.
- "User", "you": the natural person registered on the Platform or using its services.
- "Account": the personal profile created by the User to access the services.
- "Organizer": the natural or legal person who publishes events on the Platform and manages ticket sales for them.
- "Event": any activity, performance, show or initiative published on the Platform by an Organizer.
- "Ticket": a digital entitlement of access to an Event purchased through the Platform.
- "Content": the materials posted by the User on the Platform — posts, comments, reactions, tags, reviews, profile images and text.
- "Community Guidelines": the supplementary document governing permitted and prohibited conduct (/legal/community-guidelines).
- "Apple": Apple Inc., where you access the Platform through an app downloaded from the App Store (see section 17).
3. Nature of the service
Outzone is a technology platform acting as a digital intermediary between Users and Organizers, combining event discovery, ticketing and light social features. Through the Platform you can:
- discover events in your area via map and search;
- view information about events and Organizers;
- buy Tickets for published Events;
- create a profile, manage your social identity and your Content (posts, comments, reactions, tags, reviews);
- follow Organizers and other Users and build two-way friend connections.
Outzone is NOT the organizer of the Events and is not responsible for the running, quality, safety, content or possible cancellation of Events: that responsibility lies solely with the Organizer.
For each Event, checkout identifies the Ticket seller. Under an Organizer sale, the ticket contract is concluded with the Organizer and Outzone acts as technology intermediary and payment facilitator. Under an Outzone-managed sale, Outzone Sagl is the seller and merchant of record, receives the payment in full and is responsible for refunds, disputes and chargebacks; the Organizer remains responsible for running, quality and safety of the Event (see section 7).
Outzone does not yet offer chat or private messaging (DMs) (a feature that is planned but not yet active): for now, interaction between Users takes place through posts, comments, reactions, tags, reviews and follow/friend relationships, subject to visibility settings.
4. Registration and Account
4.1 Age requirements
Registration is free and reserved to natural persons who are at least 16 years old. We do not allow registration by anyone under 16.
- Users aged 16–17 have their Account set to Private by default (see section 6) and cannot switch it to Public.
- Access to certain Events may be restricted to adults (18+) under the Organizer's rules or applicable law (e.g. service of alcohol): in that case the Platform applies an age verification at the time of purchase.
4.2 Accuracy of data
You undertake to provide truthful, accurate and up-to-date data. Providing false data, impersonating others or creating fake Accounts may result in suspension or closure of the Account, in addition to any legal consequences.
4.3 Account security
You are responsible for keeping your credentials safe and for all activity carried out through your Account. You must notify us immediately of any unauthorised use. We are not liable for damage resulting from unauthorised use due to your negligence in keeping your credentials safe. We recommend using strong passwords.
5. Platform features
5.1 Event discovery and map
The Platform offers a map and search features to explore Events and access their details (description, date, location, price, Organizer profile). The map shows the location of the Event venue set by the Organizer. Results may be sorted based on your preferences and your area/city.
If you grant the optional permission for approximate location, active only while the app is in the foreground, we use it on your device to centre the map and show you nearby events. Outzone does not collect or store your device location and does not yet use background location (an opt-in, not-yet-active background-location feature is planned — see the Privacy Policy). You may revoke the permission at any time in your operating-system settings. More details in the Privacy Policy.
5.2 Ticket purchase
You can buy Tickets for published Events. The commercial terms, refund policies and your rights in the event of a change to or cancellation of the Event are governed by the Ticket Sale & Refund Terms, which you accept at checkout (see also section 7).
5.3 Profile and social identity
You can create and manage a personal profile (photo, bio, interests, events you attend). Profile visibility is governed by the visibility levels (section 6).
5.4 Connections, follows and blocking
The Platform offers follow relationships (one-way) and two-way friend relationships: a friend connection is established only if both Users confirm it (request and acceptance).
You can at any time remove a connection, block another User, or report their conduct. Blocking prevents the blocked User from viewing your profile and content, seeing your presence, and sending you friend or follow requests.
5.5 Notifications
The Platform may send you push notifications and emails (e.g. purchase receipts, social activity, relevant events, service updates). Push notifications and email receipts are on by default and you can turn them off (opt out) in the app settings or, for push, in your device's operating system. Notices that concern your rights or essential contractual matters will in any case be sent to you by email, even if push is turned off.
6. Privacy and visibility controls
You control the visibility of your profile and content.
- Account visibility levels: Public, Friends, or Private.
- Public: profile, activity and events visible to other Users.
- Friends: profile, activity and events visible only to Users with whom you have a confirmed (mutual) friend connection.
- Private: the profile is not visible or searchable by third parties.
- Privacy by default: adult Accounts (18+) are set to Public; minors' Accounts (16–17) are set to Private and cannot switch to Public.
- Changes to visibility settings apply immediately and prospectively and have no retroactive effect on data already shared or content already published.
Regardless of visibility, the Organizer of the Event for which you buy a Ticket receives the data necessary to run the Event, as described in section 7 and in the Privacy Policy.

7. Ticket purchase — identifying the seller
7.1 Payment models
- Organizer sale: the charge is associated with the Organizer's Stripe Connect account. The Organizer is seller and merchant of record, appears on the card statement, receives payment net of applicable charges and is responsible for refunds, disputes and chargebacks.
- Outzone-managed sale: the charge is made by Outzone Sagl on its own Stripe account. Outzone is seller and merchant of record, appears on the card statement as OUTZONE, retains the proceeds in full and is responsible for refunds, disputes and chargebacks. The Organizer does not need Stripe Connect and receives no per-sale payout through the Platform. Any B2B consideration between the Organizer and Outzone is separate from the consumer purchase.
Your card data is processed exclusively by Stripe and is never stored by Outzone.
7.2 Seller identity and allocation of responsibilities
Before the purchase is completed, and in any case before the "order with obligation to pay" button, you are shown the seller's identity and the total price in CHF, inclusive of VAT and of any non-optional fee. Responsibilities are allocated as follows:
- Organizer: running the Event, admission, quality, safety, communicating changes and deciding on cancellation.
- Seller identified in the order: Ticket issuance, collection, execution of refunds, disputes and chargebacks.
- Outzone: technology, support and complaints; for Outzone-managed sales it also assumes all seller obligations listed above.
For EU/EEA consumers, this information identifies the trader and allocates obligations under Art. 6a of the Consumer Rights Directive (Dir. 2011/83/EU, as amended by the Omnibus Directive 2019/2161).
7.3 Service fees
The ticket price set by the Organizer is stated net of VAT. Outzone charges a net service fee equal to 6.9% of the net ticket price + CHF 0.50 net per ticket. Outzone applies 8.1% VAT to the entire net service fee, including both the percentage component and the fixed amount per ticket. VAT on the ticket, VAT on the service fee and every other non-optional item are included in the final total shown before payment.
The buyer is not charged any additional Stripe fee beyond that total. For Organizer sales, Stripe processing costs affect the net amount settled to the connected account; for Outzone-managed sales, they are borne by Outzone.
7.4 No 14-day right of withdrawal for Tickets
Tickets are services related to leisure activities with a specific date or period of performance. Accordingly:
- EU/EEA consumers: the 14-day right of withdrawal does not apply to the purchase of Tickets, under Art. 16(l) of Directive 2011/83/EU (an exemption confirmed by the CJEU in Case C-96/21 CTS Eventim, including where the sale is made through an intermediary).
- Consumers in Switzerland: Swiss law provides no general right of withdrawal (cooling-off period) for online/distance purchases.
Any refunds are governed by the Ticket Sale & Refund Terms and by the Organizer's policy. In particular: if the Event is cancelled the Ticket price is refunded; in the event of a material change (date, venue or headline act) you are entitled, where applicable law so provides, to elect a refund rather than accept the change.
7.5 Digital services of the Platform
For any paid digital service offered by Outzone directly to the consumer and supplied immediately (not attributable to a dated Ticket), you will be asked, where applicable, to expressly consent to immediate performance and to acknowledge the resulting loss of the right of withdrawal under Art. 16(a) and (m) of Dir. 2011/83/EU. Organizer subscriptions (section 8) are B2B products and are not offered through the iOS consumer app.
8. Organizer subscriptions (B2B)
Organizers may subscribe to plans — Free, Standard (CHF 69/month) or Pro (CHF 149/month) — managed via Stripe (a trial period is supported where offered). These subscriptions relate to the Organizer dashboard features and are governed by the Organizer Terms. They are not offered through the iOS consumer app and are not aimed at consumers.
9. User conduct
You undertake to use the Platform in compliance with the law, these Terms, the Community Guidelines, good faith and respect for other Users and Organizers. The following are expressly prohibited:
- posting unlawful, offensive, discriminatory, violent, pornographic, defamatory, hateful or rights-infringing content;
- harassing, threatening or sending unwanted communications to other Users;
- circumventing others' visibility levels (e.g. taking screenshots of participant lists to spread them outside the Platform, identifying or tagging Users with a "Private" profile);
- using the Platform for spam, phishing, fraud, money laundering or other unlawful activities;
- buying Tickets for unauthorised resale (touting/scalping);
- attempting unauthorised access to systems, data or other Users' Accounts;
- using bots, scrapers, crawlers or automated tools without our prior written consent;
- compromising the operation, integrity or security of the Platform;
- falsifying your identity or impersonating others;
- using other Users' personal data for purposes other than the interaction permitted by the Platform.
In the event of a breach, Outzone may take the measures set out in section 12.
10. User-generated content (UGC)
10.1 Ownership and licence
You retain ownership of the Content you upload (photos, reviews, comments, profile content). By uploading Content, you grant Outzone a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt, publish and display that Content solely to operate, provide and improve the Platform, displaying it to other Users within the limits of your visibility settings. We may generate statistical or technical aggregates from Content in anonymous form.
The licence ends when the Content is removed or the Account is closed, save for use for backup, security or compliance with legal obligations for the strictly necessary period, and save for content already shared and reproduced by other Users before removal.
You warrant that you hold all rights necessary in the Content you upload and you indemnify us against any third-party claim in this respect.
10.2 Zero tolerance for objectionable content
Outzone enforces a zero-tolerance policy towards objectionable content and abusive behaviour. Posting content that breaches the Community Guidelines is prohibited.
10.3 Reporting, moderation and blocking
- Reporting: you can report content, profiles or events that breach the Terms or the Guidelines using the dedicated in-app feature.
- Response time: we undertake to review reports of objectionable content within 24 hours and to remove the content and/or suspend the responsible User, where appropriate.
- Block and mute: you can block or mute at any time Users whose content or behaviour you find inappropriate; blocking prevents the blocked User from interacting with you and your content.
- More details on moderation, transparency of decisions, the possibility of appeal with human review and the notice-and-action mechanism are in the Community Guidelines.
11. Intellectual property
All intellectual-property rights in the Platform — trademarks, logos, software, design, text, graphics, code and databases — belong exclusively to Outzone Sagl or its licensors. The "outzone" trademark, the logo and the outzone.app domain name are protected. Any reproduction, distribution, modification or use not expressly authorised is prohibited.
12. Suspension, restrictions and Account closure
In the event of a breach of these Terms or the Community Guidelines, or to protect other Users, Outzone may, proportionately and at its reasonable discretion, apply temporary or permanent restrictions on the Account, including a warning, removal of content, limitation of features and, in serious cases, blocking the Account. In the most serious cases (fraud, illegal activity, breaches protecting minors or vulnerable persons) we may apply the most severe measure directly.
Where required by applicable law (including Regulation (EU) 2022/2065 — the DSA), you will receive a statement of reasons for the decision and may bring an appeal as set out in the Community Guidelines.
You can close your Account at any time from the app (Settings › Delete account) or from the public page www.outzone.app/account-deletion. Deletion anonymises your identifying data; we nevertheless retain financial and ticketing records (accounting/tax and anti-fraud obligations), proof of consent and the audit log, as described in the Privacy Policy. Closing the Account does not automatically entitle you to a refund of Tickets already purchased, which remain subject to the Organizer's policy.
13. Warranties and limitation of liability
Outzone provides the Platform "as is" and "as available", without warranting uninterrupted or error-free operation, to the extent permitted by law.
To the extent permitted by applicable law, Outzone is not liable for:
- the quality, running, safety, cancellation or change of Events (the Organizer's responsibility);
- the unlawful or harmful conduct of other Users or Organizers;
- damage resulting from technical malfunctions, service interruptions or unauthorised access caused by external factors or by your negligence;
- third-party services (e.g. Stripe and the providers listed in the Privacy Policy).
Limitations and carve-out (consumers). These limitations do not exclude or limit Outzone's liability: (i) for death or personal injury caused by our fault; (ii) for wilful misconduct or gross negligence; (iii) where this is not permitted by mandatory consumer-protection law, which remains unaffected in all cases. Save for the foregoing and to the extent permitted by law, Outzone's total liability to you for damage arising from your use of the Platform is limited to the amount of the service fees actually received by Outzone in connection with the transaction that gave rise to the damage.
14. Changes to the Terms
We may amend these Terms for regulatory, technical or operational reasons. Material changes will be communicated to you through the Platform or by email with reasonable notice. Continued use of the Platform after the changes take effect constitutes acceptance; otherwise, you may close your Account. Mandatory consumer-protection provisions remain unaffected.
15. Governing law, forum and complaints
These Terms are governed by Swiss law, excluding its conflict-of-laws rules.
The courts of Lugano (Switzerland) have exclusive jurisdiction over any dispute, without prejudice to the mandatory provisions that grant the consumer the forum of their own domicile or other non-waivable protections.
For any matter, including data protection, you can contact us at info@outzone.app. On data-protection matters you also have the right to lodge a complaint with the supervisory authority:

- European Union/EEA: the competent supervisory authority of the Member State of your habitual residence.
16. Miscellaneous
- Force majeure: Outzone is not liable for failures due to causes beyond its reasonable control (disasters, war, strikes, pandemics, blackouts, cyber-attacks, failures of networks or third-party providers).
- Assignment: you may not assign your rights and obligations without our written consent. Outzone may assign the contract to group companies or in the context of corporate reorganisations, on notice, without prejudice to your consumer protections.
- Severability: the invalidity of any clause does not affect the others.
- Communications: notices to Outzone must be sent to the addresses in section 1; notices to you are made through the Platform, the registered email or push notifications.
17. Terms specific to apps downloaded from the Apple App Store
The following provisions apply in addition when you access the Platform through an application downloaded from the Apple App Store, and prevail, as to their subject matter, in the event of conflict with other clauses.
- Acknowledgement. These Terms are concluded solely between you and Outzone Sagl, and not with Apple. Outzone, not Apple, is solely responsible for the application and its content.
- Scope of licence. The licence granted for the application is limited, non-transferable and valid for use on Apple-branded products that you own or control, in accordance with the App Store Usage Rules.
- Maintenance and support. Outzone is solely responsible for any maintenance and support of the application. Apple has no obligation to provide any maintenance or support services.
- Warranty. Outzone is solely responsible for any warranties for the application, to the extent provided. In the event of any failure to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application (if applicable); to the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims are the responsibility of Outzone.
- Product claims. Outzone, not Apple, is responsible for addressing any claims by you or a third party relating to the application or your use of it (e.g. product liability, failure to conform to legal requirements, consumer protection).
- Intellectual property. In the event of any third-party claim that the application infringes intellectual-property rights, Outzone, not Apple, is responsible for the investigation, defence, settlement and discharge of such claims.
- Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any restricted- or prohibited-parties list.
- Developer. The developer of the application is Outzone Sagl, Via Grumo 31, 6929 Gravesano, Ticino, Switzerland (CHE-251.077.155). For questions, complaints or requests relating to the application, write to info@outzone.app.
- Third-party terms. You agree to comply with applicable third-party terms when using the application (e.g. your data-network operator's terms).
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, by accepting them, you acknowledge Apple's right to enforce them against you as a third-party beneficiary.
